Who these apply to

These terms cover work done by Golden Gumball — Andy and Nora Culver — for you. They apply from the point you accept a price and pay the deposit.

Nothing here replaces what we agreed on the phone. If something we wrote down for your job differs from what's below, what we wrote down for your job wins.

Price

• A website starts at $2,000. You get one number for the whole job, agreed before anything starts.
• The price doesn't move unless you ask for something we didn't agree. If that happens we tell you what it costs before we do it.
• The fixed price covers up to twenty pages. Anything bigger gets quoted before we start.
• There is no hourly rate and there are no invoices you didn't see coming.

Paying

• 50% deposit to book your week.
• The remaining 50% when the site goes live.
• Nothing in between.

Timing

We build in about a week, counted from the day you send us your photos and the details we asked for. If those come late, the week starts late — that's the one thing that moves the date.

You get a link to look the whole thing over before it goes live, and you can ask for changes as many times as you like at that stage.

The monthly

• Once the site is live it's $149 a month, and that's the only thing you pay us.
• It covers hosting, backups, security, changes, your dashboard, and your spot on TenPenny Home while you're with us.
• Changes are unlimited. Tell the editor in plain English or send them to us.
• Cancel any time, no notice. No contract, no minimum term, no cancellation fee.

If you stop the monthly, the hosting and the upkeep stop with it, and your spot on TenPenny Home goes back into the pool.

Who owns what

• Your domain is yours. It stays in your name, we never hold it, and if you ever leave you take it with you.
• Your content is yours. Your photos, your text, your logo, your reviews — yours before, during and after.
• The finished site is yours once it's paid for in full.
• You're responsible for having the right to use what you send us. If you give us photos or text belonging to somebody else, that's on you.

What we'll tell you

If we think a rebuild is the wrong answer for you, or that you don't need us yet, we'll say so before you pay us anything. That's in the about page and it's meant literally.

We build sites to bring in work, and your dashboard is there so you can see whether it's happening. What we can't do is guarantee a particular position in Google, a number of calls, or a number of jobs. Anyone who does guarantee that is guessing.

If something goes wrong

While you're paying the monthly, keeping the site online and working is our problem, not yours. Tell us and we'll fix it.

What we're liable for is capped at what you've paid us. We're not liable for lost business, lost profit, or knock-on losses.

Stopping a build partway

If you call it off after the deposit but before the site goes live, the deposit covers the work already done and isn't refunded. You don't owe the second half.

Governing law

These terms are governed by the law of the State of Wisconsin.
